De Minimis and Physical Space Waivers

De minimis and physical space waivers may provide other possible exceptions to these requirements for the following conditions:

  • De minimis conditions include having a total solid waste collection service of less than two cubic yards per week and organic waste subject to collection in the recyclable materials collection program container comprises less than ten (10) gallons per week and/or organic waste subject to collection in the organics collection program container comprises less than ten (10) gallons per week.
  • For larger generators, de minimis conditions include having a total solid waste collection service of two or more cubic yards per week and organic waste subject to collection in the recyclable materials collection program container comprises less than twenty (20) gallons per week and/or organic waste subject to collection in the organics collection program container comprises less than twenty (20) gallons per week.
  • The total weekly solid waste collection service volume for the above conditions is the sum of weekly container capacity measured in cubic yards for the recyclable materials collection program, organics collection program and solid waste collection services.
  • Evidence demonstrating that the premises lacks adequate space for the collection containers required for compliance with the organic waste collection requirements.

Businesses, organizations and agencies desiring de minimis or physical space waivers are required to submit a De Minimis Waiver Application or a Physical Space Waiver Application with the required documentation to the RWMA for review and approval. Businesses, organizations and agencies are welcome to contact the RWMA office for assistance by calling (530) 634-6890 or by emailing info@YubaSutterRecycles.com. As noted above, Local Education Agencies and Non-Local Entities desiring de minimis or physical space waivers must submit an application to CalRecycle and here is a link to CalRecycle’s webpage that includes these waiver applications and related information: https://www.calrecycle.ca.gov/organics/slcp/waivers. Businesses, organizations and agencies in Low Population Census Tract Areas with Approved Waivers and those granted De Minimis and Physical Space Waivers can still engage in waste reduction activities, grasscycling, home composting, utilize local recycling centers, or self-haul recyclable materials and organic waste to a recycling or composting facility.
